11. Good-Faith Disputes and Frivolous Claims
Mending Hearts for Mason believes disputes should be addressed reasonably, proportionately, and in good faith.
You agree not to initiate or pursue a claim or legal proceeding for the primary purpose of harassing, intimidating, maliciously injuring, imposing unnecessary costs upon, or causing unnecessary delay to Mending Hearts for Mason or anyone associated with the organization.
Nothing in these Terms prevents Mending Hearts for Mason from seeking any remedy available under applicable law in response to frivolous, abusive, malicious, or bad-faith litigation.
Where authorized by law, Mending Hearts for Mason expressly reserves the right to seek sanctions, court costs, reasonable attorneys’ fees, expenses, or other relief arising from frivolous or improper legal conduct.
Likewise, nothing in this section prevents a person from bringing a legitimate claim supported by a good-faith factual and legal basis.
12. Governing Law
These Terms of Use and any dispute arising from or relating to the Site will be governed by the laws of the State of Ohio, without regard to principles of conflicts of law, except where applicable law requires otherwise.
